IRQ busy detect?

To all,

    Anyone know how to detect if a serial port and or IRQ are currently
    being used by a driver/device?   eg. a mouse on com1. I want my
    asyncopen() to check this condition so it doesnt interuppt the
    functioning of such. Sample code can be givien in any language, so
    long as the comments/flow allow for porting to other languages.
